These Terms of Service ("Terms") are a binding agreement between you and Trovio, operated by Eduardo Assis da Silva (individual, Brazil) ("we", "us", "the Service"). By creating an account or using the Trovio mobile application, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Trovio lets you create messages (text, images, audio) anchored to physical locations. A message can only be unlocked and read by its recipients when they are physically present within the radius configured around the anchor point. Features include user profiles, following other users, reactions, and push notifications.

2. Eligibility and Accounts

• You must be at least 16 years old to use Trovio. We verify age at registration and will terminate accounts found to belong to users under 16.
• You must provide accurate registration information and keep it up to date.
• You are responsible for safeguarding your credentials and for all activity on your account. Notify us immediately of any unauthorized use.
• You may not create an account for someone else, impersonate any person or entity, or create multiple accounts to evade enforcement of these Terms.

3. Your Content

You retain ownership of the content you create on Trovio ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit and display that content solely for the purpose of operating and providing the Service — for example, storing your message and showing it to its recipients when they unlock it. This license ends when your content or account is deleted, subject to the retention periods described in the Privacy Policy.

You represent and warrant that you own or have the necessary rights to the content you post, and that it does not violate these Terms or any law.

4. Community Rules — Prohibited Conduct

You may not use Trovio to create, post, share or link to content that, or otherwise engage in conduct that:

• Is illegal, or promotes, facilitates or coordinates illegal activity — including theft, robbery, fraud, scams, phishing, pyramid or "get-rich" schemes, or the sale of illegal goods;
• Sexually exploits or endangers minors in any way (zero tolerance — such content is removed and reported to the competent authorities);
• Harasses, threatens, intimidates, defames or bullies any person, or incites hatred or violence against individuals or groups;
• Deceives others — impersonation, misinformation intended to cause harm, or fraudulent misrepresentation of your identity or affiliation;
• Lures or directs any person to a location with intent to harm, rob, harass, stalk or endanger them, or anchors messages in a way designed to make someone enter a dangerous or unlawful place;
• Exposes the personal data of others without their consent (doxxing), or records/shares private information obtained without authorization;
• Infringes intellectual property or other proprietary rights;
• Contains malware, or links designed to compromise devices or steal credentials;
• Constitutes spam, bulk unsolicited messaging, or commercial advertising without our prior written consent;
• Attempts to probe, scan, overload or breach the Service's security, scrape data, use automated clients or bots, spoof GPS location to circumvent unlock rules, reverse engineer the app, or circumvent rate limits, blocks or other technical protections.

We may remove content, restrict features, suspend or permanently terminate accounts that violate these rules, at our sole discretion, with or without prior notice. Where required or appropriate, we cooperate with law enforcement and may preserve and disclose information as described in the Privacy Policy.

5. Physical Safety — Important

• Trovio anchors messages to real-world locations. You are solely responsible for your own safety and for observing your surroundings when moving toward or unlocking a message.
• Do not enter private property, restricted, hazardous or unlawful areas to create or unlock a message. Anchoring a message somewhere does not mean the location is safe, accessible or lawful to visit.
• Do not use Trovio while driving, cycling or operating machinery.
• GPS positioning is inherently imprecise. We do not guarantee the accuracy of location readings, message radii, or that a message will unlock at an exact spot.
• We do not verify, endorse or inspect anchor locations chosen by users.

6. Reporting, Blocking and Moderation

• You can report any message or user directly in the app. Reports are reviewed and acted on — typically within 24 hours for content that appears to violate Section 4.
• You can block any user in the app. Blocked users cannot interact with you or see your content.
• We may review, filter, refuse or remove User Content at any time to enforce these Terms, but we do not pre-screen all content and are not obligated to monitor it.

7. Privacy

Our Privacy Policy explains what data we collect (including precise location), why, how long we keep it, and your rights under the LGPD and GDPR. It is part of these Terms.

8. Intellectual Property

The Trovio name, logo, application, design and underlying software are our property or licensed to us, and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or brand assets. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on your personal devices for its intended purpose.

9. Third-Party Services

The Service integrates third-party components — such as Google Sign-In (optional authentication) and map data providers. Your use of those components may be subject to the respective third party's terms. We are not responsible for third-party services.

10. Service Availability and Changes

Trovio is provided free of charge at this time. We may modify, suspend or discontinue any part of the Service, introduce new features or impose usage limits. We will make reasonable efforts to give advance notice of material changes that negatively affect you.

11. Termination

• By you: you may stop using the Service and delete your account at any time in the app's settings. Deletion follows the 30-day process described in the Privacy Policy.
• By us: we may suspend or terminate your account if you violate these Terms, if required by law, or if the Service is discontinued. Where reasonable, we will notify you of the reason.
• Sections that by their nature should survive termination (including Sections 3, 4, 8, 12, 13 and 14) survive.

12. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by applicable law, we disclaim all warranties, express or implied, including fitness for a particular purpose, uninterrupted availability, and accuracy of location data. We are not responsible for the conduct of any user, on or off the Service, nor for User Content created by others.

13. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for indirect, incidental, special, consequential or punitive damages, or loss of data or goodwill, arising from your use of the Service — including damages resulting from the conduct of other users, from visiting physical locations, or from reliance on location accuracy.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including your mandatory rights as a consumer under the Brazilian Consumer Protection Code (CDC) or equivalent consumer protection laws of your country of residence.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify us against claims, damages and reasonable expenses arising from your User Content, your violation of these Terms, or your violation of any law or third-party right — except to the extent caused by our own fault.

15. Changes to These Terms

We may update these Terms. The "Last updated" date above reflects the latest version. For material changes we will notify you in the app or by email before they take effect. Continued use of the Service after the effective date constitutes acceptance; if you do not agree, you must stop using the Service and may delete your account.

16. Governing Law and Disputes

These Terms are governed by the laws of the Federative Republic of Brazil. If you are a consumer, you retain the protections of the mandatory consumer laws of your country of habitual residence, and any judicial disputes may be brought in the courts of your own domicile where consumer law so provides.
